As announced last week, we will now provide you with our data processing agreement (“DPA”). We ask you to provide us a signed copy as soon as possible but latest Thursday, 24th May 2018.
Let me briefly explain the necessity and the urgency of the DPA:
On 25th May 2018 the General Data Protection Regulation (GDPR) comes into effect within the European Union. The GDPR will have a major effect on how we must handle personal data, esp. regarding transfer, process, storage and deletion of personal data
The GDPR aims at ensuring a uniform level of data protection for personal data within the EU as well as for personal data that is sent abroad and which is processed for a party in the EU. As we are sending you personal data (names etc.) on a regular basis we are obliged to enter into an agreement with you that safeguards data protection and meet the high standards of the GDPR.
To fulfil all requirements and to maintain legal conformity we have attached our DPA. The DPA will constitute an agreement between you and Active Abroad regarding the handling of personal data. Please note, from the Friday, 25th May 2018, it is mandatory under GDPR that the transfer of our candidate’s personal data is governed by an agreement, such as our DPA. This means, that if we have not received a signed copy of the DPA until 25th May 2018, we unfortunately cannot send you any more candidates. Please note, that your company details as well as signature is required in multiple pages (p. 1 & p. 9)
We value our long-lasting successful cooperation with your company and look forward to us continuing to work together but we do need assurances that your company is working towards full GDPR compliance by the 25th of May this year.
We ask you to treat our data processing agreement (“DPA”) confidential as it is copy righted.
